Ministry of Railways Enhances Ex-Gratia Relief for Victims of Train Accidents and Untoward Incidents

New Delhi, September 23, 2023 – In a significant move aimed at providing greater support to those affected by train accidents and untoward incidents, the Ministry of Railways has announced a revision in the ex-gratia relief amount for the dependents of deceased and injured passengers. This revision, as per the provisions outlined in Section 123, Section 124, and Section 124-A of the Railways Act, 1989, extends to road users who are involved in accidents attributed to the prima facie liability of the Railways at Manned Level Crossing Gates.

Under the revised guidelines, the maximum amount of ex-gratia relief to be provided will be increased to a substantial sum of up to Rs. 50,000/-, which will be disbursed in cash to facilitate immediate assistance for addressing initial expenses.

This commendable initiative by the Ministry of Railways signifies a commitment to enhance the support and financial assistance provided to the dependents of those affected by train accidents and untoward incidents. The revised rates and accompanying instructions have been carefully compiled to ensure a streamlined and efficient process for relief disbursement.

end of every 10 day period or date

of discharge, whichever is earlier.

Rs. 1,500/- per day to be released at the end

of every 10 day period or date of discharge, whichever is earlier upto further six month of hospitalization.

 

Thereafter, Rs. 750/- per day be released at

the end of every 10 day period or

date of discharge, whichever is earlier upto further five month of hospitalization.

(a) Lump sum amount of ex-gratia for hospitalization of grievously injured passenger

upto first 30 days is as mentioned in table at para (1) above.

(b) The maximum period for which ex-gratia is payable to the grievously injured passenger will be 12 months.
